Terms & Conditions for Artist Membership:

This list of terms and conditions is not a comprehensive list and may be altered prior to any executed Exhibit of the Artist’s work.

Online Gallery:

Application:

To apply for participation in our online Gallery, please fill out the Artist Membership Application HERE. Artists of all experience levels are welcome!

Benefits:

Artist Membership includes:

  1. Exhibit your work for sale on our Online Gallery for 12-months after the receipt and processing of your application.

  2. Get listed in our Member Catalog; every TPHAF Artist Member receives an Artist Profile on our website featuring their artwork, links to their websites and/or social media profiles, and a description of their artist practice.

  3. Promoted Artist Profiles; members Profiles are marketed through our social media channels.

  4. TPHAF Members are eligible to answer our Call to Artists, for exhibition opportunities with partnering Galleries/Venues

  5. Inclusion in Live Members Exhibitions; in addition to the online gallery, live Exhibition opportunities will be held at The Peacock House, 710 Orange Ave. Fort Pierce FL 34950. Members will be welcome to hold live exhibitions of works during the annual membership (dates/times of exhibitions will be posted on our online calendar). 

  6. All TPHAF Artist Members can submit work to our Annual Juried Exhibition for FREE (Non-members must pay $20 per entry).

List Payments:

All applications are pending until payment is received and processed. Payments can be made on the Application Form located HERE.

Application Processing:

Please allow 7 - 10 business days after the submission and acceptance of your application for the completion of your Artist Profile and the uploading/curating of your works into our Online Gallery.

Application Approval:

All applications are subject to review and must be approved by the Board. If your application is denied for any reason you will receive a refund. Refunds are subject to the terms and conditions of the 3rd party payment systems used to initiate payment (example: PayPal’s Terms and Conditions).

Curation:

Please ensure that the “TPHAF Artwork List” is filled out correctly and clearly in order to ensure the online gallery correctly displays the title/name, description and price of your artwork. TPHAF is not responsible for any mislabeling due to inaccurately submitted forms. As a courtesy, you will be contacted the day your Artist Profile goes live to review any issues/typos. Any changes/updates to your work(s) must be submitted with an updated “TPHAF Artwork List” form to TPHAF.Inc@gmail.com

Advertising/ Marketing:

  1. The Artist may share/promote their Exhibit(s) on social media/advertising, however, any use of the logo/contact information of The Peacock House Art Foundation, Inc must be approved in writing beforehand by TPHAF.

  2. Members Profiles are marketed through our social media channels. All materials/information submitted to TPHAF will be used for the purposes of marketing your Artwork(s)/Profiles. The submission of your application/artwork/material to TPHAF hereby serves as your acceptance of this agreement, any trademarks/copyrights/etc of materials submitted are voided for the use of advertising your artwork, name and  website/social media. You may request to revoke the advertising of any works/media with a written request and we will remove them within five (5) business days of the receipt of this request. 

Sales:

  1. Each piece of Artwork will be priced as described on the submitted “TPHAF Artwork List”. It is the Artist’s sole responsibility to price the works correctly and clearly to ensure the correct sale price (please be sure to include any tax if applicable).

  2. The sale of any Artwork on the Online Gallery will incur a 10% commission, payable to The Peacock House Art Foundation, Inc. (not including tax). This is for the administrative costs of sales.

  3. The sale of any Artwork at The Peacock House and/or at our partnered Galleries/Venues will incur a 10% commission, payable to The Peacock House Art Foundation, Inc. (not including tax). This is for the administrative costs of sales.

Live / In Person Exhibits:

The Venue:

The Peacock House Art Foundation, Inc. is proud to provide the opportunity for member Artists to Exhibit or showcase their work with a partnered Venue(s). This list of terms and conditions is not a comprehensive list and may be altered prior to any executed Exhibit of the Artist’s work. The Venue has final say of all terms and conditions, and is required to provide the Artist a comprehensive list of these terms in writing prior to the execution of the Exhibit.

Insurance:

The Artist shall insure their work. Neither the Venue nor TPHAF are liable for lost, stolen, or damaged property and shall not be held responsible for the safekeeping of consigned works.

Dates & Times of Exhibit:

  1. The Venue will display the artwork for the agreed upon dates, listed in the written agreement between TPHAF and the Venue. However, both the Artist and the Venue maintain the right to terminate this agreement at any time with 48-hours written notice provided to The Peacock House Art Foundation, at TPHAF.Inc@gmail.com

  2. The Artist must pick up their work by the last day of the Agreement Term, neither the Venue nor TPHAF is not responsible for the storing of the artwork after the expiration of this agreement. Any artwork and/or supplies (business cards, hooks, card holders, etc) left behind by the Artist will be considered trash for indiscriminate disposal by either the venue or TPHAF.

Curation & Set Up:

  1. The Artist is responsible for presentation and set up of their work, as well as breakdown/removal. However, the final curation and approval of the set up, remains the sole discretion of the Venue. 

  2. The Venue will determine how the art is to be hung/exhibited, such as providing the Artist with hanging hooks/rods. NO nails/screws/other hanging devices may be used by the Artist without the written approval of the Venue. Any damage to the walls of the Venue from wrongfully installed nails/screws will be billed to the Artist. 

  3. All Artists are to create and provide their own description cards – typed on cardstock, with the name of the art, description of the medium used, the size, the price, the Artist’s name/company – in that order, unless otherwise agreed upon in writing with the Venue.

  4. Any in-person / live exhibits where the Artist is invited by the Venue to be present and showcase their work in person for any amount of time, must be negotiated and agreed to in writing by the Artist and the Venue. The Peacock House Art Foundation is not responsible for any event set up, nor is TPHAF liable for any interactions between the Artist and the Venue’s patrons/customers/visitors.

Sales:
